National security cannot be sold out. Five departments jointly issued a document: Automobile data shall not be provided overseas

The official conclusion has finally been reached on issues involving national security and social public interests such as automobile data and road information. On August 20, the Cyberspace Administration of China, the Ministry of Industry and Information Technology, the National Development and Reform Commission, the Ministry of Public Security, and the Ministry of Transport jointly issued the "Several Provisions on Automobile Data Security Management (Trial)" (hereinafter referred to as the "Provisions"), which will come into effect on October 1.

The Regulations emphasize that automobile data processors should comply with regulations that require data to be stored within the country in accordance with the law, and implement institutional requirements such as risk assessment reports to actively protect data security and prevent data security risks.

In addition, according to the Regulations, automobile data processors must also proactively report on annual automobile data security management.

It must be mentioned that if the business really needs to provide important data to overseas, the automobile data processor must also conduct a security assessment in accordance with the requirements for data export, and supplement the relevant information in the annual report on automobile data security management. It is not allowed to provide important data that exceeds the scope of the security assessment to overseas in violation of regulations.

With the evolution of automobile intelligence, the development of smart cars and vehicle networking technologies has accelerated, and the ability of cars to collect road data has been increasingly enhanced. As a result, automobile data security issues and hidden dangers have become increasingly prominent.

Officials said the regulations aim to standardize data processing and management in the automotive industry, protect the legitimate rights and interests of individuals and organizations, maintain national security, and ensure that the development and utilization of automotive data is controlled within a reasonable range.

Regarding the collection and processing of automobile data, the Regulations encourage data processors to adhere to principles such as "in-vehicle processing", "non-collection by default", "desensitizing processing", and "use within a range of accuracy" to reduce the collection and abuse of automobile data beyond a reasonable range.
