Legal liability for illegal cultivation of drug raw materials

1. According to Article 71 of the Public Security Administration Punishment Law of the People's Republic of China:

Whoever illegally plants less than 500 poppy plants or a small amount of other raw drug plants shall be detained for not less than 10 days but not more than 15 days, and may be fined not more than 3,000 yuan; if the circumstances are relatively minor, he shall be detained for not more than 5 days or fined not more than 500 yuan.

2. According to Article 351 of the Criminal Law of the People's Republic of China:

Whoever illegally plants more than 500 but less than 3,000 poppy plants or a large number of other drug raw plants shall be sentenced to fixed-term imprisonment of not more than five years, criminal detention or public surveillance, and shall also be fined.

Whoever illegally plants more than 3,000 poppy plants or a large number of other drug raw plants shall be sentenced to fixed-term imprisonment of not less than five years and shall also be fined or have his property confiscated.
