Not long ago, the Yishui County Court in Shandong Province reported a case in which a WeChat group snatched red envelopes for donations for epidemic prevention. The defendant Li was sentenced to the crime of theft and a fine of 2,400 yuan.

According to the case, on January 31, 2020, Li joined the WeChat group "Alumni of a Certain University" by scanning the QR code shared by his WeChat friends in the Moments. Knowing that the red envelopes in the group were received by a dedicated person and used to purchase donated anti-epidemic materials, Li grabbed two red envelopes on the same day, totaling 300 yuan.

After the group members found out, they asked Li to return the red envelope, but Li refused and left the group. Later, Li entered the group again by scanning the QR code and grabbed 5 red envelopes totaling 900 yuan.

According to reports, in the WeChat group's lucky red envelope distribution, the sender voluntarily distributes red envelopes of varying amounts and numbers within the group, and the red envelope grabbers can grab red envelopes of varying amounts. There is a gift relationship between the sender and the grabber, and it has nothing to do with illegal or criminal activities.

However, the property in the exclusive red envelope has ownership and points to a specific right holder. It is not a random red envelope that anyone can grab.

Before the right holder receives the red envelope, the red envelope still belongs to the person who sent it.

Therefore, the act of knowingly snatching away exclusive red envelopes sent by others to special persons in a WeChat group is obviously suspected of being illegal, and if the amount is large, it constitutes theft.

Before grabbing a red envelope, you should first determine whether the red envelope is for group members to grab for entertainment or has a specific owner. If it is an exclusive red envelope, you should not reach out for it.
