Article 23: An employer and an employee may agree in the employment contract to keep the employer's business secrets and confidential matters related to intellectual property rights. For workers who have confidentiality obligations, the employer may agree with the worker on a non-competition clause in the labor contract or confidentiality agreement, and agree to provide the worker with monthly financial compensation during the non-competition period after the labor contract is terminated or canceled. If an employee violates the non-competition agreement, he or she shall pay liquidated damages to the employer in accordance with the agreement.

Article 25: Except for the circumstances stipulated in Articles 22 and 23 of this Law, an employer shall not agree with an employee that the employee shall bear liquidated damages.
